What is professional negligence?

Lawyers owe you a duty of care, which means they have to provide their services with skill and diligence.  To prove professional negligence, you have to show they have breached this duty of care.

This means proving their standard of work was not as good as you could reasonably expect.  This might include your lawyer not acting within the set time frame for making a claim, or giving you inaccurate advice about your case. 

You have to prove that you are worse off than you would have been if they had not acted negligently.  If you are just disappointed with the outcome of your case, this does not necessarily mean your lawyer was negligent.
