Broken leg may lead to compensation claim

An accident at work in which a man suffered a broken leg may result in him seeking personal injury compensation.

Jan Kaminski was working as a produce packer for Surya Rice - which has four operational centres in the UK as well as several bases around Europe - at the Harwich Industrial Estate when he was struck from behind by a forklift truck transporting goods across the depot's floor.

As a result of the impact, Mr Kaminski sustained a fracture to his right leg and severe bruising to his left knee and in a subsequent court case, it was established that his employer's negligence had caused the incident.

Surya was found to have permitted the unnecessary use of the factory vehicle in a "heavily congested work area" which therefore restricted the driver's vision and admitted breaching the Health and Safety Act 1974.

Consequently, the 49-year-old could seek a damages settlement from the company.
