Lydia Eaton, who is 102-years-old, took legal action against the Medway NHS Foundation Trust after she was wrongly discharged from hospital following an incident where she broke her pelvis in February 2007.
Ms Eaton was injured when she fell over at home at Rogers House in Wigmore and she was subsequently taken to A&E at the Medway Maritime Hospital for treatment.
Despite the fact she was in severe pain and could not walk, Ms Eaton returned home from the institution some eight hours later after doctors decided she was fit enough to be discharged.
However, over the course of the next few months, her condition deteriorated and she had to be moved to a specialist care home.
Therefore, her daughter Elaine Griffin decided to seek damages and Judge Sweeney at the High Court has now ruled she is entitled to £35,000 for her ordeal.
