Brigstock Saw Mill in Kettering has been fined £5,000 after a worker was seriously injured whilst working on an unguarded piece of machinery.
An unnamed agency worker was feeding materials into a saw, levering it with a crow bar, when he slipped and his left hand was drawn into the blade. His ring finger was caught in the blade and he needed to undergo plastic surgery to correct the damage.
The Health and Safety Executive, who oversee safety in the workplace, investigated the incident and discovered that the saw blades were left without a guard. They also found that the company had not taken effective measures to ensure that staff were safe from accidents at work.
Midlands Renewable Fuels LLP (Brigstock Saw Mill) has been fined £5,000 with costs of £876.50 and a £175 victim surcharge, after pleading guilty to breaching health and safety at work regulations.
The owners of the saw mill have now installed a protective wooden box around the machinery so operators cannot get close to the dangerous blades.
Employers have a duty of care to ensure that we are safe at work. If you are ever asked to work on machinery that you believe to be unsafe or not in good working order then you can refuse to use the equipment.
The same applies if you are asked to do a job that you don’t think you have been trained to do, or if you haven’t been supplied the right equipment to carry out the job safely. Also if you think the equipment you have been given isn’t fit for purpose, or damaged in some way, you have the right to say that you won’t do the work until it is safe.
Every business has to have employer’s liability insurance if they have people working for them so if you’re injured at work through no fault of your own you can claim compensation. This comes from the insurance company and not your employer so you don’t have to worry about them being out of pocket. You also can’t be fired or made to feel bad about claiming compensation for a work place accident.
